We are determined that always be compliant with any law to fulfill our contractual obligations to protect your rights and to fulfill our legitimate business interests.

ABOUT OUR COMPLIANCE TOOL

What personal information do we collect and use in our compliance tool?
When you use our compliance tool it is only your email address at work that we are processing and saving. Your email address at work is used as user id in our compliance tool. When you are changing any company information in the compliance tool, we are saving these changes into a change log together with your email address and time of change. We are NOT using your email address to anything else AND we are NOT sharing your email address with others.

If you are using our compliance tool as a employee or consultant for a supplier that has got a product request from a customer, we are asking for your name and mobile phone number to verify you as the user who is responding to the product request. Your entered phone number is used to send a verification code to your mobile phone and your name and phone number is only used and saved as information in the change log together with the replied information. We are NOT using your email address to anything else AND we are NOT sharing your name and mobile phone number with others.

If you have received product requests from customers, that are using our compliance tool, to your company in your mailbox. You can contact them and request that you should be removed as contact to your company. If you want to know which companies have you as a contact for your company, please contact us.

How long do we keep your privacy information?
Your account is kept until your company removes your account.  Our change log is kept as long as your company is subscriber to our compliance tool.

Your privacy rights.
Your privacy rights differ from different regions but you can ask any person at your company that is administrator of the subscriber account to remove your account from our compliance tool. If you have questions or comments about your privacy rights, you may email us at info@chemity.eu. The easiest way to exercise your rights is by contacting us. We will consider and act upon any request in accordance with applicable data protection laws.

How do we keep your information safe?
We have organisational and technical processes and procedures in place to protect your personal information. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cyber-criminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.

We have implemented appropriate and reasonable technical and organisational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cyber-criminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

When you are visiting any of our web pages, we do not collect, use or save any personal information about your activity.

The new Ecodesign Regulation came into effect on July 18th. Do you know what this means for your company?

On 18 July 2024, the EU’s new Ecodesign Regulation came into effect, marking a significant shift towards more sustainable products in the European market. This regulation gradually replaces the previous directives from 2009 and introduces stricter environmental requirements for a broader range of products.

Key Changes

  • Expanded Coverage: The new regulation now covers almost all products sold within the EU, with a few exceptions such as food, pharmaceuticals, and veterinary products. Previously, the focus was solely on energy-related products.
  • Digital Product Passport: Every product will now require a digital product passport, containing information on raw materials, manufacturing processes, and environmental impact, making it easier for consumers to make environmentally conscious choices.
  • Emphasis on Durability and Recyclability: Greater emphasis is placed on the durability, repairability, and recyclability of products to extend their lifecycle and reduce waste.
  • Stricter Rules on Obsolescence and Disposal: New, stricter rules address product obsolescence and the disposal of unsold goods, including restrictions on how these can be managed.

Timeline

The first work plan for the Ecodesign for Sustainable Products Regulation (ESPR) for several prioritised product groups is expected to be completed by April 2025. Deadlines and transition periods for ecodesign measures will be specified in delegated acts, with the first expected around 2026 for certain textiles and steel. With an 18-month transition period, the requirements are anticipated to take effect around 2027/2028.

What Does This Mean for Companies?

If your company markets products within the EU, it’s crucial to begin assessing the impact of the ESPR and stay informed about its implementation. This is particularly important for companies dealing with prioritised products like textiles and steel.

It’s also advisable to familiarise yourself with the new definition of hazardous substances. For the first time, a definition of “substances of concern” is introduced, which has a broader scope than the previous SVHC (Substances of Very High Concern) criteria. This category includes substances that cause chronic aquatic toxicity, are harmful to the ozone layer, cause specific organ toxicity, or negatively affect the reuse and recycling of materials.

Actions for Companies

  • Sustainable Product Design: Companies need to prioritise designing products that are more durable, repairable, and recyclable. This involves rethinking material choices, manufacturing processes, and the entire product lifecycle.
  • Increased Transparency and Compliance: Companies must enhance transparency by clearly labelling products and providing detailed information on their environmental impact. Adhering to the new regulations will require better oversight of product compliance.
  • Collaboration Across the Supply Chain: Companies should collaborate across the entire supply chain to ensure products meet sustainability requirements and develop sustainable solutions in partnership with industry peers.

The EU’s New Climate Requirements for Imports (CBAM)

 Serious Consequences for Companies That Fail to Act. Is Your Company Ready?

The EU’s new Carbon Border Adjustment Mechanism (CBAM) is a key part of the Union’s strategy to reduce carbon emissions and ensure fair competition between domestic and imported goods. These requirements apply to all importers of CBAM-regulated goods, whether they are businesses or individuals. This includes all imports into the EU, even goods ordered online.

CBAM affects all businesses importing the following goods:

  • Iron and steel products, and goods made from these materials, such as pipe fittings, profiles, and screws
  • Aluminum and aluminum products
  • Fertilizers (with some exceptions)
  • Cement products (with some exceptions)
  • Chemicals (currently limited to hydrogen)
  • Electrical energy

There are ongoing discussions about including additional product categories, such as plastics. Certain exceptions exist, such as goods with KN numbers not listed in the CBAM regulation and imports valued under 150 EUR.

But what does this mean for your business, and how can you ensure compliance?

The Transition Period: Preparing for the Future

The EU introduced CBAM in May 2023, with the aim of applying an additional carbon fee on imported goods that have not already paid for their emissions during production. During the ongoing transition period, from 2024 to 2025, the EU is collecting emissions data from importers to determine the final tariffs to be implemented in 2026.

Starting in early 2024, Swedish companies importing CBAM goods were required to report climate data for imports made in the last quarter of 2023. This requirement was enforced even if detailed information was not available, as default values could be used. However, the rules have become stricter as of July this year.

Stricter Rules from Summer 2024

Since summer, importers are now required to report actual emissions figures for all imports made during the third quarter of 2024. The deadline for submitting this report is October 31st. It’s important to note that direct customs agents cannot handle the reporting under CBAM regulations, even if they usually manage all the administrative work related to customs declarations.

To avoid issues, it is crucial to ensure that you have access to the necessary climate data from your supplier or manufacturer before making any purchases or imports, in compliance with CBAM regulations. If a non-EU manufacturer refuses to share their emissions data, the importer must demonstrate that they have made every effort to obtain this information. This is a clear indication that the EU is striving for greater transparency and accountability.

What Does This Mean for the Future?

By 2026, all importers of CBAM goods must apply for import authorization. This permit is essential to continue importing goods into the EU. Without authorization, imported goods may be stopped at the border, and companies could face significant costs, whether the goods are stored, destroyed, or returned.

The National Authorities responsible for granting import authorizations, will conduct a thorough review of the company’s financial standing and compliance with CBAM regulations. Companies that violate EU rules or have been involved in economic crimes will be excluded, further emphasizing the importance of compliance.
